Terms and Conditions

Please read these terms and conditions carefully. By accessing the platform, booking services, or clicking “i agree,” you acknowledge that you have read, understood, and agree to be legally bound by this entire agreement, including the binding arbitration clause and class action waiver in section 9. If you do not agree to these terms, do not use the platform or book services.

Definitions

Agreement (Terms & Conditions): This contract between PlusTidy, LLC (“PlusTidy,” “we,” “us”) and each Client.

Company / PlusTidy: PlusTidy, LLC, including its owners, officers, employees, agents, affiliates, successors, and assigns. PlusTidy operates solely as a referral and administrative platform connecting Clients with independent Helpers.

Platform: PlusTidy’s website (www.plustidy.com), scheduling tools, communications, booking systems, and third‑party processors (e.g., Square) used to connect Clients and Helpers and to facilitate scheduling, billing, and limited messaging.

Client: An individual 18+ who accesses the Platform, books or receives Services, or allows Services to be rendered to any member of their household. The Client is responsible for compliance with these Terms and for the condition and safety of the premises where Services occur.

Helper: An independent service provider referred through the Platform to perform Services for a Client. Helpers are independent contractors, not employees, agents, partners, or joint venturers of PlusTidy. Helpers control the manner and means of their work.

Services: Non‑medical, in‑home household support tasks performed by Helpers, such as general tidying, laundry folding, basic organizing, simple meal prep (non‑specialty), and other routine home assistance agreed at booking. Services exclude childcare, supervision of dependents, personal care, medical or therapeutic tasks, administering medication, transportation of any person, water/bathing supervision, heavy/industrial cleaning (unless booked as “Deep Cleaning”), licensed trades, and any illegal or unsafe activity.

Service Appointment: A confirmed booking (date/time/location) scheduled via the Platform for a Helper to provide Services at the Client’s premises.

Independent Contractor: A Helper who determines their own methods, timing, and tools; is responsible for taxes, licenses, insurance, supplies, and legal compliance; and may accept or decline any referral.

Third‑Party Processors: Independent vendors used by PlusTidy for payments, scheduling, or communications (e.g., Square).

Nature of Services & Platform Role

Referral/Administration Only. PlusTidy connects Clients with independent Helpers and facilitates scheduling and payments. PlusTidy does not provide Services and does not supervise or control Helpers. No outcome or specific Helper is guaranteed.

Scope. Services offered via the Platform are non‑medical and non‑caregiving. Helpers may not: provide childcare or dependent supervision; administer medications; provide medical, therapeutic, or other licensed services; perform intimate/personal care; transport individuals; supervise swimming/bathing; or engage in any activity prohibited by law or these Terms.

Permitted examples (non‑exhaustive):

  • General tidying and light cleaning (e.g., wipe counters, load dishwasher)
  • Laundry folding and basic organizing
  • Simple meal prep (non‑allergen‑specific)
  • Other routine household tasks agreed at booking

Excluded examples (non‑exhaustive):

  • Childcare or dependent supervision of any kind
  • Deep cleaning/heavy lifting unless specifically booked
  • Medical/therapeutic care; personal care; behavioral services
  • Pet grooming; outdoor/yard work; licensed trades
  • Any unsafe or illegal activity

Availability & assignments. All appointments are subject to Helper acceptance and availability. Recurrence and specific Helpers are not guaranteed. Substitutions or rescheduling may occur; we’ll notify you when feasible.

Independent Contractor Acknowledgment

All Helpers are independent contractors who:

  • Control how Services are performed
  • May accept/decline any referral and work for others
  • Set their own availability
  • Provide their own tools/supplies/transportation
  • Are responsible for their own taxes, insurance, licenses, and expenses

PlusTidy’s role is referral and administration only. Nothing here creates an employment relationship.

Client Eligibility, Accounts & Obligations

Eligibility. Clients must be 18+, legally able to contract, and agree to these Terms.

Account & accuracy. Provide accurate contact details, service address, payment method, and relevant household information—and keep them current. Inaccurate data can cause delays, safety issues, or failed appointments and may affect refunds.

Security. Protect your login and devices. Notify hello@plustidy.com immediately of suspected unauthorized use.

Permitted use & anti‑solicitation. Use the Platform only to book Services. Do not:

  • Circumvent Platform scheduling, messaging, or payments
  • Retain a referred Helper off‑platform for substantially similar paid services for 12 months after the last referral without PlusTidy’s written consent or a buyout
  • Scrape data or misuse Platform features

Conduct. Provide a respectful, safe, sanitary environment. Prohibited conduct includes harassment, discrimination, unsafe conditions, intimidation, or demanding tasks outside the permitted scope.

Disclosure of risks. Before each appointment, disclose material risks/conditions (e.g., aggressive pets, weapons, hazards, illness, active cameras in service areas). Failure to disclose is a material breach and may result in cancellation, charges, suspension, and indemnification obligations.

Bookings, Payments & Fees

Booking. Schedule via the Platform (online scheduler, approved email requests, or other authorized methods). Bookings are requests until confirmed.

Payments. Processed by Third‑Party Processors (e.g., Square). By booking, you authorize charges to your stored payment method for base rates, add‑ons, surcharges (e.g., holidays), overtime, cancellations/no‑shows, and adjustments for actual time worked.

Timing of charges.

  • One‑time: charged at confirmation (or as stated at checkout)
  • Recurring: charged after service completion based on actual hours

Rates. Current rates are those published on the Platform at booking and may vary by service, location, demand, or frequency. Additional fees may apply for holidays, last‑minute requests, extended/overnight visits, or special requests.

Cancellations.

  • ≥ 8 hours’ notice: no fee
  • < 8 hours’ notice: $50 fee may apply
  • No‑show (no access within 15 minutes of start): scheduled time may be charged
    PlusTidy may waive/adjust fees in documented emergencies or at our discretion.

Refunds/Credits. At our discretion, we may assign a replacement Helper for a future booking or issue a credit/refund in limited cases (e.g., verified service failure or serious misconduct). Style differences or unreported issues (24+ hours after service) generally do not qualify. Repeated chargebacks/refund demands may lead to deactivation.

Disputes. Billing disputes must be emailed to hello@plustidy.com within 5 calendar days of the charge. We will review and respond in good faith. Do not initiate a chargeback before completing this process.

Safety Protocols

Maintain safe access, disclose hazards, and ensure pets do not endanger Helpers. Helpers may decline or end a visit for safety concerns. In emergencies, Helpers may contact 911, exit the premises, and notify the Client and PlusTidy. PlusTidy does not provide emergency training or oversight.

PlusTidy may decline, cancel, or terminate services or Platform access for safety risks, misconduct, or breaches of these Terms.

Disclaimers & Liability

No outcome guarantees. Experiences vary by household conditions, expectations, and Helper approach. Use of the Platform and Services is at the Client’s own risk.

Platform role. PlusTidy does not employ Helpers, direct their work, or provide training beyond Platform orientation. We facilitate referrals, scheduling, and billing. Clients are responsible for evaluating suitability.

Insurance. Helpers are independent businesses. PlusTidy does not provide insurance for Helpers or incidents during appointments. Clients are encouraged to maintain homeowners/renters/personal‑liability coverage.

Limitation of damages. To the maximum extent permitted by law, PlusTidy is not liable for indirect, incidental, special, or consequential damages; emotional distress; lost time/income; or property damage not directly caused by PlusTidy.

Cap on liability. If PlusTidy is found liable, our total liability shall not exceed the amount paid by the Client for the specific appointment giving rise to the claim, or $100 if no payment was made, unless a higher minimum is required by law.

Nothing herein waives rights that cannot be waived under applicable law. PlusTidy does not disclaim liability for its own gross negligence, willful misconduct, or fraud.

Force majeure. We are not liable for delays/failures caused by events beyond our control (e.g., severe weather, outages, government orders, public health emergencies).

Indemnification

To the fullest extent permitted by law, the Client agrees to indemnify and hold harmless PlusTidy and its representatives from claims, losses, damages, costs, and attorneys’ fees arising from: Client negligence or misconduct; breach of these Terms; unsafe premises or undisclosed risks; or conduct of household members/guests/pets. This does not apply to claims based solely on PlusTidy’s gross negligence or intentional misconduct. These obligations survive termination.

If a claim may trigger indemnity, PlusTidy may assume control of the defense and settlement; the Client agrees to cooperate and not settle without PlusTidy’s written consent.

Privacy & Data Protection

We collect only what is needed to coordinate Services: contact details, service address, scheduling preferences, booking history, limited technical data, and payment credentials processed by Third‑Party Processors.

We use this data to book/coordinate Services, process payments, provide support, maintain records, improve the Platform, and comply with law. We do not sell Client data.

Vendors access data only as needed to perform their functions and are contractually bound to protect it. We use commercially reasonable safeguards; however, no system is perfectly secure. If a breach occurs, we will notify affected Clients as required by law and take corrective steps.

Dispute Resolution

Good‑faith first. Email hello@plustidy.com with a description of the issue, the appointment date, and the resolution you seek. We generally respond within 10 business days.

Arbitration. To the fullest extent permitted by law, disputes arising from these Terms, the Platform, Services, or billing shall be resolved by final and binding arbitration under the AAA Consumer Rules. Venue may be virtual or in Harris County, Texas, unless otherwise agreed. The arbitrator’s decision is final and enforceable.

Small claims. Either party may pursue an eligible claim in Harris County, Texas small‑claims court on an individual basis.

Class‑action waiver. Disputes must be brought individually, not as a class or representative action. If the waiver is unenforceable as to a specific claim, that portion is severed and the rest of the arbitration clause remains effective.

Governing law. These Terms are governed by the laws of the State of Texas, without regard to conflict‑of‑law rules.

Limitation on claims. Any claim must be filed within one (1) year after it arose.

Attorneys’ fees. The prevailing party may recover reasonable fees and costs as allowed by law.

General Provisions

Modifications. We may update these Terms. Material changes will be posted on the Platform and/or emailed. Continued use after notice constitutes acceptance. If you do not agree, discontinue use.

Entire agreement. These Terms (and incorporated policies) are the entire agreement and supersede prior communications.

Severability. If a provision is unenforceable, the remainder stays in effect; the provision will be interpreted to reflect the parties’ intent where possible.

No waiver. Failure to enforce a provision is not a waiver.

Assignment. Clients may not assign these Terms without our written consent. PlusTidy may assign in connection with a merger, sale, or reorganization; Terms bind any successor.

Clickwrap. By checking a box, clicking “I Agree,” booking, or using the Platform, you consent to these Terms electronically (E‑SIGN/UETA). We may require re‑affirmation upon updates.

Entity disclosure. The Platform “PlusTidy” is operated by PlusTidy, LLC.
